The “best interests of the patient” standard—a complex balance between the principles of beneficence and autonomy—is the driving force of ethical clinical care. Clinicians’ fear of litigation is a challenge to that ethical paradigm. But is it ever ethically appropriate for clinicians to undertake a procedure with the primary goal of protecting themselves from potential legal action? Complicating that question is the fact that tort liability is adjudicated based on what most clinicians are doing, not the scientific basis of whether (...) they should be doing it in the first place. In a court of law, clinicians are generally judged based on the “reasonably prudent” standard: what a reasonably prudent practitioner in a similar situation would do. But this legal standard can have the effect of shifting the medical standard of care—enabling a standard‐of‐care sprawl where actions undertaken for the primary purpose of avoiding liability reset the standard of care against which clinicians will be adjudicated. While this problem has been recognized in the legal literature, neither current ethical models of care nor legal theory offer workable solutions.One of the best examples of the conflict between evidence‐based medicine and common clinical practice is the use of electronic fetal monitoring. Despite strong evidence and professional guidelines that argue against the use of EFM for healthy pregnancies, the practice persists. In today’s neo-liberalist world, Islamic financial institutions face many difficulties combining contemporary financial thinking with Islamic, faith-based principles, on which their day-to-day operations ought to be based. Hence, IFI are likely to experience shifts/changes in organizational and ethical identity due to tensions that the combination of these principles invokes. We present an in-depth case study that focuses on these shifts in a major European based IFI across a 14-year period. We conceptualize identity change as drift, highlighting the multivocal nature of (...) identity construction. The ethico-faith principles that were meant to serve as living codes of ethics guiding the IFI’s organizational culture, operational processes, and strategy formation turned out to mainly have been discursively rationalized to respond to regulatory, market and institutional imperatives. The company is aware that it needs to engage in a continuous dialogue with those who set these requirements. Its ethico-faith principles may consequently be adapted quite radically, especially in periods of turmoil and takeover, as we show across the analysed time period. The paper provides valuable insights for faith-inspired organizations to reflect on the extent to which they wish to engage in the discursive justification and legitimization of current market hegemonies, whilst they actively encourage their managers to behave ethically as well. Metaphysical realism is the view that most of the objects that populate the world exist independently of our thought and have their natures independently of how, if at all, we conceive of them. It is committed, in my opinion, to a robust form of essentialism. Many modern forms of anti-realism have their roots in a form of conceptualism, according to which all truths about essence knowable by us are ultimately grounded in our concepts, rather than in things 'in themselves'. Die Begriffe der "wirklichen" oder "metaphysischen" Möglichkeit und Notwendigkeit werden verteidigt und von den Begriffen verschiedener anderer Arten von Modalität unterschieden, z.B. physischer, logischer und begrifflicher Möglichkeit oder Notwendigkeit. Es wird dargelegt, daß die Gegner der Metaphysik, von den Relativisten bis zu denen, welche die Metaphysik (...) den empirischen Wissenschaften, der Erkenntnislehre oder der Sprachphilosophie unterordnen möchten, inkohärente Auffassungen annehmen. Pressing beyond the ready-made enlightenment offered by the subject-object framework, Walter Lowe uncovers a number of remarkable convergences between the contemporary philosopher Jacques Derrida and the early twentieth-century theologian Karl Barth.

I favour an analysis of selfhood which ties it to the possession of certain kinds of first-person knowledge, in particular de re knowledge of the identity of one's own conscious thoughts and experiences. My defence of this analysis will lead me to explore the nature of demonstrative reference to one's own conscious thoughts and experiences. Such reference is typically ‘direct’, in contrast to demonstrative reference to all physical objects, apart from those that are parts of one's own body in which (...) one can localize sensations or which are directly subject to one's will. My conclusion will be that the semantic distinction between ‘direct’ and ‘indirect’ demonstrative reference helps to delineate the metaphysical boundary between oneself and the rest of the world. But I do not contend that one is to be identified with one's own body: indeed, I shall try to show that one can know a priori that no such identity can obtain. (shrink)

De Neys's incisive critique of empirical and theoretical research on the exclusivity feature underscores the depth of the challenge of explaining the interplay of fast and slow processes. We argue that a closer look at research on mindreading reveals abundant evidence for the exclusivity feature – as well as methodological and theoretical perspectives that could inform research on fast and slow thinking.

This article investigates the theoretical assumptions and implications of de Ste. Croix’s approach to interstate politics in The Origins of the Peloponnesian War. It suggests that two approaches can be identified in the work: one which sees a fundamental connection between political systems within a state and that state’s conduct of interstate politics, and another, closer to conventional ‘Realist’ theories, which sees a clear dividing line between domestic and interstate politics, and in which interstate relations need to be understood according (...) to a distinct analytical framework. Although this tension was probably not a particular concern to de Ste. Croix himself, it does have a bearing on ongoing debates in International Theory; the final part of the article briefly explores the possibility that the concept of ‘compulsion’, important to both Thucydides’ and de Ste. Croix’s understanding of the causes of the Peloponnesian War, might provide a way of reconciling these two approaches. (shrink)

The frame associated with a classical point particle is generally noninertial. The point particle may have a nonzero velocity and force with respect to an absolute inertial rest frame. In time–position–energy–momentum-space {t, q, p, e}, the group of transformations between these frames leaves invariant the symplectic metric and the classical line element ds2 = d t2. Special relativity transforms between inertial frames for which the rate of change of momentum is negligible and eliminates the absolute rest frame by making velocities (...) relative but still requires the absolute inertial frame. The Lorentz group leaves invariant the symplectic metric and the line elements $ds^{2} = -dt^{2} + \frac{1}{c^{2}} dq^{2}$ and $d \mu^{2} = dp^{2}-\frac{1}{c^{2}}de^{2}$ . General relativity for particles under only the influence of gravity avoids the issue of noninertial frames as all particles follow geodesics and hence have locally inertial frames. For other forces, the question of the absolute inertial frame remains.) Born conjectured that the line element should be generalized to the pseudo-orthogonal metric $ds^{2} = -d t^{2}+\frac{1}{c^{2}} dq^{2} + \frac{1}{b^{2}}(dp^{2}-\frac{1}{c^{2}}de^{2})$ . The group leaving this metrics and the symplectic metric invariant is the pseudo-unitary group of transformations between noninertial frames. We show that these transformations also eliminate the need for an absolute inertial frame by making forces relative and bounded by b and so embodies a relativity that is shape reciprocal in the sense of Born. En faisant usage des intuitions de la philosophie de la science, l'étude compare les voies d'approches en recherche néotestamentaire et en philologie classique. La recherche néotestamentaire a mis en oeuvre une certaine méthode qui était en vogue en philologie classique durant le 19ème siècle, mais qui fut finalement rejetée par la plupart des philologues classiques. Il s'agit d'une méthode sceptique plutôt que critique, car elle rend toute prétention à la connaissance problématique ou même impossible. Son origine dernière se trouve dans (...) la méthode du doute systématique proposée par Descartes. Telle qu'elle est pratiquée aujourd'hui, cependant, la méthode sceptique est semblable à la philosophie de la science suggérée par le cercle de Vienne en les années 1920, mais que les héritiers de cette école regardent aujourd'hui comme trop simpliste. Des exemples concrets, tirés de la pratique courante de la recherche, montrent comment une méthode sobrement critique peut trouver place dans les études du Nouveau Testament, à condition seulement que les dangers de la méthode sceptique soient clairement aperçus. La connaissance métaphysique est accessible et nous possédons un tel type de connaissance. Il faut pratiquer la métaphysique de manière directe, sans passer par des considérations de philosophie du langage ou de l'esprit. Les deux principales critiques de la métaphysique sont : le naturalisme évolutionniste et le kantisme. Le naturalisme est incohérent car il nie la possibilité défaire des hypothèses métaphysiques et pourtant il repose sur de telles hypothèses. Kant également ne va pas au bout de son projet, car on (...) ne peut éviter la question du contenu des pensées, une fois qu'on a réduit la métaphysique à une théorie de la connaissance. L'examen des arguments de Barcan-Kripke confirme la possibilité d'une argumentation métaphysique et l'impossibilité d'y échapper. Metaphysical knowledge is accessible and indeed, we have such a knowledge. Metaphysics shoud be done directly, without starting with considerations of philosophy of language or philosophy of mind. The two main critiques of metaphysics are evolutionary naturalism and Kantianism. Naturalism is inconsistent because it denies any possibility to make metaphysical hypotheses, but it hinges upon such hypotheses. Kant is also inconsistent because one cannot avoid the question of the content of thoughts once metaphysics has been reduced to epistemology. A scrutiny of the arguments by Barcan and Kripke confirms the possibility of a purely metaphysical argumentation and the impossibility to do without it. (shrink)

Frickenhaus argued that in Plautus’ Pseudolus and Stichus and Terence’s Heauton Timorumenos, Hecyra and Phormio the Latin dramatist was responsible for a third stage-house, whereas the Greek models of these plays had only two, the norm for New Comedy. Frickenhaus’ unjustly neglected arguments are here revived and reinforced. It is also argued that Plautus’ Cistellaria and Trinummus are further cases of the same phenomenon.

All Aristotelians subscribed to the thesis that the soul as the principle of life has many powers. But how are the powers related to the soul’s essence? It has often been argued that medieval philosophers gave two answers to this ques- tion: some took them to be necessary accidents that are distinct from the soul’s essence, whereas others simply identified them with the essence. This paper intends to show that there were alternatives to these two standard models. Peter of John (...) Olivi argued that the powers are not accidents but substantial forms that constitute the soul’s essence. He thereby defended a strong mereological thesis, for he assumed that the powers are literally parts that make together a whole. Henry of Ghent also rejected the idea that powers are accidents. Instead, he defended the claim that a power of the soul is a whole constituted by the soul’s essence and a relation determining the essence to an act and an object. In making this claim, Henry proposed a determination thesis. The paper dis- cusses both theses in detail, looks at the arguments Olivi and Henry adduced against the two standard models, and evaluates their theories in the historical context. (shrink)

With the advent of the cloud computing model allowing a shared access to massive computing facilities, a surging demand emerges for the protection of the intellectual property tied to the programs executed on these uncontrolled systems. If novel paradigm as confidential computing aims at protecting the data manipulated during the execution, obfuscating techniques (in particular at the source code level) remain a popular solution to conceal the purpose of a program or its logic without altering its functionality, thus preventing reverse-engineering (...) on the program even with the help of computing resources. The many advantages of code obfuscation, together with its low cost, makes it a popular technique. This paper proposes a novel methodology for source code obfuscation that can be used together with other traditional obfuscation techniques, making the code more robust against reverse engineering attacks. Three program complexity metrics are used to define three different single-objective combinatorial optimization versions of the problem, which are solved and analysed. Additionally, three multi-objective problems are defined, those considering each of the selected metrics together with the program execution time, in order to avoid strong obfuscations penalizing the performance. The goal of the defined problems is to find sequences of LLVM optimizations that lead to highly obfuscated versions of the original code. These transformations are applied to the back-end pseudo-assembly code (i.e., LLVM Intermediate Representation), thus avoiding any further optimizations by the compiler. Classical genetic algorithms (GAs) are used to solve the studied problems, namely a basic cellular GA for the single-objective problems and the popular NSGA-II for the multi-objective ones.
